How would the online sportsbooks law affect gambling venues?

(Lima).- The Association of Winemakers of Peru asked the Ministry of Foreign Trade and Tourism to analyze the regulation of the law so that it does not affect these businesses.

How would the online sportsbooks law affect gambling venues?

On June 28, the modification of the law that regulates the exploitation of remote gaming, betting and remote sports was published. The norm will regulate the methods for the taxation of this type of games and will enter into force 120 days after the publication of its regulations.

At the moment it is not known on what date the Ministry of Foreign Trade and Tourism (Mincetur) will issue the regulation, but the Association of Winemakers of Peru reached 700 observations so that they can be considered in said document.
El Comercio spoke with Andrés Choy, president of the union, who pointed out that his main concern is that the regulations be pre-published to find out in detail how the law will be applied and if winemakers will be considered within this legal framework. If this is the case, the identification of the players will be required from the wineries.

“The bets include the lotteries offered by the wineries, the Tinkas or tickets that are sold. For example, you have to give a guarantee on the prizes or register or film the players to identify them. It doesn't make sense,” he said.

The representative refers to the modifications to article 11 of the law, which require that a player must register before playing a distance bet. According to the norm, the owner authorized to exploit the technological platforms of these games must identify the identity, age and nationality of the players for the registration of the bets. Clean union representative seeks that the wineries are not included within this requirement.

He also expects them to be exempted from the modification to article 24, which requires that the owner authorized to operate remote betting pay a guarantee of 3% of the annual net income that he enters for this concept.

What we don't want is for things to be imposed on us or not treated like a casino or slot machines. […] If these types of issues are imposed on us, carrying out a lottery in the wineries will stop being profitable, ”he remarked.

The representative of the winemakers does not allow him to come looking for a date to have an interview with the Minister of Foreign Trade and Tourism to detail his concern.

Cellars and games

The Peruvian Sports Betting Association (Apadela) agreed that it is important to pre-publish the regulation so that there is no error when applying the new law. He added that there are currently more than 550,000 wineries nationwide that provide the betting service they prefer.

"It is an important relationship, since they are a relevant sales channel and on the other hand, for wineries, the sale of mutual sports betting means an additional income that also generates more traffic at the points of sale, which translates into more sales of other products," the union said.
